Terms and Conditions for Materials and Delivery by Trecon Services LLC.

1. Price Changes: All prices are subject to change without prior notice.
2. Natural Variation: Landscaping materials are natural products. Trecon Services LLC is not liable for any variation in color, size, or appearance.
3. Return Policy: ALL SALES ARE FINAL. Trecon Services offers pick-up services for returned items. Each return will be treated as a new pick-up/delivery and charged accordingly. Customers are fully responsible for returning materials and must provide immediate payment for pick-up/delivery of returned items at the time of service.
4. Delivery and Damage: Trecon Services LLC is not responsible for any damage caused by delivery trucks to driveways, concrete, waterlines, underground utilities, landscaping, or any other aspect of the property. Customers assume all risk associated with delivery.
5. Payment Terms: All charges are due upon delivery. In the event legal action is required to collect payment, the customer agrees to pay reasonable attorney fees, court costs, and any associated fees. An 8% service charge will be applied monthly to past due accounts. If payment is not made in full, Trecon Services LLC reserves the right to place a mechanic’s lien on the property improved by the materials, which could result in foreclosure.
6. Street Deliveries: Trecon Services LLC is not liable for materials placed on the street. Customers are responsible for moving materials off the street and placing reflective cones as needed.
7. Indemnity: Customers agree to indemnify and hold Trecon Services LLC harmless against any claims, demands, or lawsuits related to loss, damage, or personal injury incurred during loading, unloading, or handling of materials.
8. Product Appearance: Trecon Services LLC makes no guarantee regarding the specific color, size, or other cosmetic characteristics of materials. Variations, including naturally occurring colored fines, may be present.
By accepting delivery of materials, customers agree to these terms and conditions.
